On April 25, 2023, a constitution bench of the Supreme Court of India rendered a split verdict, with a 3:2 majority that an arbitration agreement as well as an instrument containing an arbitration agreement, which is subject to stamp duty but remains unstamped or has insufficient stamping, cannot be given legal effect since it cannot be considered a legally enforceable contract, unless it is duly stamped.
