Privacy Policy

1. General

This Privacy Policy applies to all current and former users accessing or using Our Platforms, or otherwise engaging with us through email or other means (collectively, “You” or “Your”); and is not applicable to the collection and processing of information in the course of our delivery of Services, or any other contractual/commercial engagements entered into by us with You and the same shall be in accordance with the terms applicable thereto. 

By visiting, accessing or using Our Platforms or by otherwise giving Us Your Information, You confirm that You have the capacity to enter into a legally binding contract and have read, understood and agreed to the practices and policies outlined in this Privacy Policy. 

You must be at least 18 years of age or older to access Our Platform. Minors may only use the Platform with the involvement, supervision, and approval of a parent or legal guardian. 

You hereby consent to Our collection, use, sharing, and disclosure of Your information as described in this Privacy Policy. 

This Privacy Policy may be updated from time to time, and Your continued access to, or use of the Platforms, shall be deemed to be an acceptance of the said changes. If You do not agree with this Privacy Policy at any time, in part or as a whole, do not access/use the Platforms or services provided through the Platform, or provide Us with any of Your Information. 

If You are accessing or using the Platforms from any geographical location other than India, You will be solely liable for compliance with any local laws, as may be applicable. 

2. Information Collected and Use of Information

2.1 Information Collected:

The information which may be collected by Us from You can by any information in relation to an identified or an identifiable person including but not limited to basic information like Your name, Your employer, Your title, Your position; contact information such as Your contact number, postal address, e-mail address.  

In case of employees and Pioneer Legal consultants (retained lawyers) and/ or interns, certain financial information such as bank account details, biometric information, passwords and details of your kin, are collected by Us a part of Our business acceptance procedures and includes details of Your visits to Our offices or of any other meetings We may have with You; information you may provide to Us for the purposes of attending events or meetings, such as access or dietary restrictions or requirements; information provided to Us by You in relation to a job application; information in relation to your visit to Our Platform or in relation to materials and communications exchanged electronically; Your account information such as dates of payments made, owed or received or any other sensitive personal data or information provided to Us by You or obtained by Us from a third party. You may also choose to provide Us Information about Your physiological health condition, sexual orientation, and/or medical records or any other background information. (collectively referred to as “Information”). 

We collect the Information about You, both through offline documentation that You may provide, as well as when You use Our Platforms. 

We understand that the Information provided by You to Us is voluntarily. Collection, use, and disclosure of Information requires Your express consent unless there are other legal grounds available to us to collect such information as further specified in this Privacy Policy. By using or accessing the Platforms or otherwise providing Us with Your Information, where applicable, You are providing Us with Your consent to Our use, collection, retention, transfer, and disclosure of the Information in accordance with the terms of this Privacy Policy. 

In the event of a change in the law applicable to data protection in India, You hereby expressly consent to Our continued use, storage, collection and disclosure of Your Information to the extent permitted under the applicable law. 

You may choose to not provide Us with or withdraw any or all Information, but in the event that You do so, We may be unable to allow you to access the Platforms or otherwise avail services for the provision of which Your Information is being collected or processed. 

2.2. Use of Information

We will be processing Your Information in connection with our professional activities which will include the fulfilment of our legal or regulatory obligations, on the basis of your consent, performance of a contract, compliance with a legal obligation or legitimate interest. The Information may be used by Us for purposes including but not limited to: providing and/or assessing Our services, building databases for creating credentials, conducting market research, for practice-development, complying with our legal and regulatory obligations, managing Our business development and marketing activities, such as briefings and invitations to Our events; handling Your job application or otherwise managing Our recruitment processes, generating statistics regarding the use of Our Platform or to analyse and improve on Our Platform and fulfilling Our legal, regulatory and risk management obligations, including establishing, exercising or defending legal claims (“Purpose”). 

Further, We may use Information relating to and as provided by You on Our social media platforms including but not limited to LinkedIn, Instagram, Twitter and Facebook, to the extent it is relevant or relating to our services and You are aware/ part of it. If You connect with Us through any of these services, then such engagement will be subject to the terms of service and privacy policy of the relevant social media platform and You should review the same before connecting with Us on such social media platforms. Our processing of Your Information in the context of Your visit to, and use of Our Platforms are based on Our legitimate interests to operate an internet website and blogs for general information and communication purposes, to optimize Our website and blogs, and to protect it from attacks. Furthermore, Our processing of Your Information for providing regulatory updates or conducting other business development activities serves the legitimate interests of the users to receive training in legal matters and know-how and serves Our legitimate interests to develop Our business and promote client relationships. 

In addition to the above, We may also use Your Information for Our internal operational purpose, such as: record keeping, accounting and compliance with applicable tax laws; for the purpose of recording timestamps and geographical locations at which Our Platform have been accessed by using various tracking technologies; providing regulatory updates that We believe are relevant for You, to invite you for seminars, webinars and workshops conducted by Us which We believe may be of interest to You; to investigate, precent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or as required by law; and to respond to Your queries and to communicate information to You, including notifications of alerts and updates to the Platform. 

3. Sharing of Information

We may disclose your Information to third parties (located in or outside India) in order to achieve the Purposes (as specified above) including (a) third parties relevant to the legal services We provide, such as counterparties, other counsel, courts, regulatory bodies and government institutions; (b) third parties we engage with in order to comply with legal obligations, such as our professional advisers and auditors; (c) third parties in connection with the processing of Your Information; (d) third party providers that involve data processing such as financial services, litigation support, research, client contact, forensic and security services; and (e) third parties engaged with us to provide banking and insurance services. We will only disclose Your Information to such third parties for the purposes of providing our services to You. Where we do so, we will do this in accordance with applicable data protection laws and will take appropriate safeguards to ensure its integrity and protection. 

Some of the third parties with whom we share personal information may be located outside Your country or the country from which the personal information was provided. While such third parties will often be subject to privacy and confidentiality obligations, You accept that, where lawful, such obligations may differ from and be less stringent than the requirements of the privacy laws of the jurisdiction of origin. 

4. Third Party Services

The Platform may contain links to third party websites and services (“Third Party Services”) upon which We have no control or authority. We are not responsible for any collection or disclosure of Your Information by such companies or persons thereof. Such third-party websites, and external applications or resources, accessible via the Platforms may have their own privacy policies governing the collection, storage, transfer, retention and/ or disclosure of Your Information that You may be subject to. 

Further, We are not liable for any loss or damage which may be incurred by You as a result of the collection and/or disclosure of Your information via Third Party Services. We shall not be liable for any disputes arising from or in connection with such transactions between You and the aforementioned third parties. 

5. Security of Your Information

We endeavour to maintain physical, technical and procedural safeguards that are appropriate to protect Your Information against loss, misuse, copying, damage or modification and unauthorized access or disclosure. 

We maintain reasonable security practices and procedures to ensure that the Information We collect is safe and secure. Access to Your Information shall be limited to Our employees, consultants, agents, advisors and third-party associates, to the extent necessary. While we shall take all reasonable and appropriate measures to secure any information which we hold about you and prevent any unauthorized access, this is not an absolute guarantee of your information’s security. To the widest extent permissible by applicable law, we disclaim all liability in relation to any possible breach of security or unintended loss or disclosure of information in relation to your information. 

6. Retention of Information

Subject to any legal requirements that requires the contrary, it is Our policy to retain Your Information only for as long as we believe it to be necessary and in accordance with applicable laws, for the Purposes illustrated in this Privacy Policy. 

7. Disclaimer

We cannot ensure that all of Your Information will never be disclosed in ways not otherwise described in this Privacy Policy. Therefore, although We are committed to protecting Your privacy, We do not promise, and You should not expect, that Your Information or private communications will always remain private. As a user of the Platforms, You assume all responsibility and risk for Your use of the Platform, the internet generally, and the information You post or access and for Your conduct on and off the Platforms. 

8. Indemnity

You agree and undertake to indemnify Us in any suit or dispute by any third party arising out of disclosure of information by You to third parties either through Our Platforms or otherwise, and Your use and access of websites, applications and resources of third parties. We assume no liability for any actions of third parties with regard to Your Information which You may have disclosed to such third parties.
