Once seen as a resource exclusive to the privileged, the internet has evolved into a widespread phenomenon, offering diverse opportunities to people of all genders, ages, and locations. Presently, the internet is heavily used for voice/video communication and the creation of audio/video content for broad public consumption.
Consequently, over-the-top (OTT) platforms like Netflix, Disney Hotstar, and YouTube have surged in popularity. These platforms distribute streaming content over the internet, accessible on various devices such as mobile phones, smart TVs, computers, and tablets. The logical progression appears to be the regulation of OTT platforms, which in India falls under the purview of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules”) in conjunction with the Information Technology Act, 2000 (“IT Act”).
